Contest Rules and Regulations
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.
The NewsSlide Free Tuition for UT Student Contest (“the Contest”) is sponsored by The Blade, 541 Superior Street, Toledo, Ohio 43660 (“Sponsor”). The Contest is governed by these official rules (“Official Rules”). By participating in the Contest, each contestant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor, are final in all respects. The Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law. Any questions, comments or complaints regarding the Contest should be directed to Sponsor in written form at the address listed above.
The Contest is open only to current University of Toledo students (full or part-time; undergraduate or graduate; and regardless of whether the contestant may also be enrolled at another educational institution, including a high school) who have downloaded The Blade NewsSlide app, which is only offered on an Android Phone/Tablet or an Apple iPhone/iPad. In order to qualify for the Contest, contestants must use an Android Phone/Tablet or Apple iPhone/iPad device for the download. Contestants must be eighteen (18) years of age or older at the time of entry. Contestants must download The Blade NewsSlide App and have Internet access and a valid e-mail account. The Sponsor has the sole and complete discretion to determine and verify the eligibility of each contestant, and may consider, among other things, whether the entrant has a current University of Toledo student number.
The Contest begins on Saturday, October 7, 2017, and ends on Monday, May 24, 2018. Sponsor reserves the right to extend or shorten, or terminate or abandon, the Contest at its sole discretion.
There will be two winners of the Contest, one determined by random drawing from among the contestants during the fall semester for the University of Toledo, and one determined by random drawing from among the contestants during the spring semester at the University of Toledo. A contestant who entered during the fall semester need not re-enter the Contest for the spring semester, but the contestant must continue to be eligible to win during the spring semester. The contestant who wins the fall semester Prize is not eligible to win the spring semester Prize. The Prize for each winner is a gift of a voucher for tuition for one semester at the University of Toledo with a value not to exceed $5,000 (“the Maximum Value”). The voucher will entitle the winner to a credit for up to the Maximum Value to cover course tuition and fees, but not books, supplies, or other materials, for one single semester at the University of Toledo. The voucher must be used within one (1) year of its award. The voucher cannot be used to pay tuition for more than one semester, even if the winner’s tuition for one (1) semester is less than the Maximum Value. The voucher is not redeemable for cash nor can the winner receive any refund based upon the voucher if the winner withdraws from the University of Toledo, regardless of any rules the University of Toledo may have or adopt for refunds of tuition. The Sponsor will notify the winners that they have won the Contest after the random drawings by any means the Sponsor determines in its sole discretion, including via email. The winners must claim the Prize, in person, at The Blade, 541 N. Superior St., Toledo, OH 43660, between the hours of 8:30 a.m. and 5:00 p.m., local time, within 10 days of notification of being a Prize winner. Positive identification, as determined to be sufficient in the sole discretion of the Sponsor, will be required and subject to verification.
Incidental expenses and all other costs and expenses which are not specifically listed as part of a Prize in these Official Rules, and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded Prize, are solely the responsibility of the Prize winners. ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE ARE SOLELY THE RESPONSIBILITY OF THE WINNERS.
HOW TO ENTER AND PLAY
Contestants must download The Blade NewsSlide App during the Contest period and sign up for a free account using an email address the University of Toledo provides for all students.
Winners will be notified via the email address they sign up with in the NewsSlide App, and this will be the only notification provided. Each contestant is responsible for monitoring his or her email account for Prize notification. Instructions for claiming your Prize will be contained in the email. If a Prizewinner does not claim the Prize within 10 days, the Prize is forfeited. The Sponsor may require the winner, as a condition of claiming the Prize, to submit an Affidavit of Eligibility, Release and Prize Acceptance Form, and IRS W-9 form and failure to do so will disqualify the winner, in Sponsor’s sole discretion. Prizes may not be awarded if in the exercise of Sponsor’s sole discretion it deems that an insufficient number of eligible contestants have entered the Contest.
No substitution or cash equivalent of Prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting of these Official Rules, the selection and announcement of any winner, or the distribution of any Prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend, or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines, in its sole and unlimited discretion, that (a) the Contest cannot be conducted as planned, or (b) a virus, bug, tampering or unauthorized intervention, technical failure or other cause has corrupted the administration, security, fairness, integrity or proper play of the Contest. In the event Sponsor determines, in its sole discretion, that tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue, to void all or any number of the entries to the Contest, to invalidate any winners and take action to reclaim Prizes, to cancel the Contest at any point, and to take any other actions it deems in its sole discretion to be appropriate. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS SPONSOR AND ITS PARENT, AFFILIATES AND SUBSIDIARY COMPANIES, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. SPONSOR AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
EXCEPT WHERE PROHIBITED BY LAW, CONTESTANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS CONTEST OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY WAY OF ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION CONDUCTED IN LUCAS COUNTY, OHIO; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS CONTEST, BUT IN NO EVENT ATTORNEYS’ FEES WHICH ARE HEREBY WAIVED BY BOTH PARTIES; AND (3) UNDER NO CIRCUMSTANCES WILL CONTESTANTS BE PERMITTED TO OBTAIN AWARDS FOR, AND CONTESTANT HEREBY WAIVES ALL RIGHTS TO CLAIM, INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES, OR THE RIGHTS AND OBLIGATIONS OF THE CONTESTANT AND SPONSOR IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF OHIO, WITHOUT REFERENCE TO ITS CONFLICT OF LAW PRINCIPLES.
By participating in the Contest, each contestant grants Sponsor permission to use his or her name, likeness or comments for publicity purposes without payment of any consideration.
THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.
